The "leggi provvedimento" (Private, Special and Local Laws) and labour law

The Department of Law, Political and International Studies of the University of Parma is organizing for September 2021 an international study conference on the so-called "Leggi provvedimento" (private, special and local laws, issued by legislative bodies but regulating only very specific cases) featuring participation of foreign scholars and with the call for proposals to all stakeholders. The conference shall feature several speakers and will be held in remote videoconference mode using the technological resources made available by the University of Parma and it will be free of charge, both for the speakers and for the participants.

The strong presence in Italy of laws aimed at a single case (a person, a place or a very specific circumstance) which are called "Legge provvedimento" (literally order/measure laws), that leads to a more general reflection, in order to establish whether this practice is only specific of Italy, where it has played a significant role in handling economic crises of companies, protection of national safety and the link between promotion of employment and protection of the workplace. In this context, the researches should focus on presenting examples in a comparative key and, at the same time, on their critical discussion, in order to examine the constitutional legitimacy of these solutions and the regulatory strategies, with their impact on the overall structure of labour law. The purpose of the conference is not to present the specifics of leggi provvedimento but rather to understand the relevance of the problem on the national legislation and regulation structure, in order to understand whether the phenomenon has consequences on the required abstractness of laws and substantially undermines the principle of equality, also causing a possible violation of competition between companies and the protection of workers.

The conference's languages are English and French, chosen by the speakers. Without prejudice to the choice of speakers by the Department of Law, Political and International Studies of the University of Parma, whoever wishes to speak must submit a brief indication of the themes of their contribution and objectives (maximum three pages) by March 31, 2021. The admitted works will be announced by April 30, 2021 and the decision will be taken by the Organising Committee. The deadline for final version of speeches is July 31st, 2021 and will be published on the conference's website. The date of the meeting will be specified in the spring of 2021 and the meeting will be in September 2021. After the conference, the proceedings will be published in a special issue of the journal Variazioni su temi di diritto del lavoro which is classified in the highest category ("Class A ") according to the official classification of Italian legal journals.
